TikTok has stated that selling to a US-based owner is not possible for them, commercially, technologically, or legally. The company is now faced with the prospect of going dark on January 19 unless the Biden administration provides clarity and assurance to service providers that the ban will not be enforced.
The Justice Department has reiterated its stance that TikTok poses a national security risk and has lauded the Supreme Court’s decision. Attorney General Merrick Garland stated that the decision allows the department to prevent the Chinese government from using TikTok to undermine US national security.
President Trump, who has also been involved in the TikTok ban, has indicated that he may intervene to prevent the ban from going into effect. Trump has suggested that he has the authority to stop the ban and is considering issuing an executive order to suspend it for a period of time.
Joe Biden’s administration has stated that TikTok should remain available to Americans, but under American ownership or ownership that addresses national security concerns. The administration recognizes that the implementation of the ban must be left to the next administration, which takes office on Monday.
In his concurring opinion, Justice Neil Gorsuch noted that the future of TikTok remains uncertain, hinting that Trump may choose not to enforce the ban. It remains to be seen what actions will be taken regarding TikTok once the new administration takes office.
